Federal Judge says Center for Medical Progress may release all unedited undercover videos to House Committee on Oversight and Government issues

On Tuesday Federal Judge William Orrick ruled that David Daleiden and The Center for Medical Progress may respond to a House subpoena seeking all unedited video footage of CMP’s undercover videos that investigated Planned Parenthood and affiliates of the National Abortion Federation’s trafficking in baby body parts.

The subpoena was issued September 15 by Congressman Jason Chaffez (R-Utah), chairman of the House Committee on Oversight and Government issues. “Planned Parenthood and the National Abortion Federation want to hide their activities from the American people,” Chaffez said in a statement. “This subpoena is a demand for transparency.

On July 31, Judge Orrick (of the Northern District of California) issued a temporary restraining order against CMF blocking the organization from releasing recorded video footage from NAF’s annual meetings in 2014 and 2015.

In his to-the-point four-page opinion released yesterday, Judge Orrick began by noting that NAF urged him to “interfere” with CMP’s response to the subpoena.

“NAF makes no argument that the subpoena itself is infirm,” he wrote. “Congress has the power to investigate, and it is not up to the courts to go beyond the narrow confines of determining that the committee’s inquiry is in its province.”

“Nor may court assume (and I do not assume) that an unworthy purpose prompts a congressional act. And, importantly in our Constitutional system there are three equal branches of government, and courts should refrain from creating needless friction with a coordinate branch of government. … As explained by the Supreme Court, it is not the Court’s role to determine the legitimacy of the Congressional investigation by looking to the Committee’s motives.”

Judge Orrick also held that CMP “shall deliver to counsel for NAF and to the Court a true and correct copy of everything defendant will provide to Congress.”

House Judiciary Committee Chairman Bob Goodlatte (R-Va.) and Constitution and Civil Justice Subcommittee Chairman Trent Franks (R-Ariz.) released the following statement this morning:

“Thursday’s hearing will be another opportunity for members of the House Judiciary Committee and the American public to understand the horrific details involved in late-term abortions and what is required in order to harvest baby body parts.

“The Committee will assemble a panel of medical experts and witnesses who have firsthand knowledge of the atrocities that occur within an abortion clinic.”
