Missouri Attorney General Eric Schmitt Files Appeal of Lower Court Ruling on House Bill 126

On November 13, Attorney General Eric Schmitt and Solicitor General John Sauer filed a motion to appeal the lower court ruling on sections of Missouri’s strong pro-life HB 126.

“In their defense of HB 126, Attorney General Schmitt called into question the validity of the lower court’s ruling against both the ban on abortion solely for the diagnosis of Down Syndrome and also the ban on abortion at 8, 14, 18, and 20 weeks gestational age,” said Steve Rupp, President of Missouri Right to Life. “According to their Brief of Appellants, no Eighth Circuit case and no U.S. Supreme Court case has ever considered or addressed restrictions similar to those contained in House Bill 126. “

Rupp continued, “Due to the reasons stated above and because Missouri has multiple compelling state interests involving ‘critical questions of life, death, freedom, and suffering for mothers and their unborn children,’ Attorney General Schmitt has also filed a Motion to Expedite Oral Arguments, asking the Eighth Circuit to schedule oral arguments from February 10-14, 2020.”

“Missouri Attorney General Schmitt and his legal team have been working diligently to protect innocent human lives here in Missouri,” Rupp concluded.

“We applaud their efforts and are grateful to have such principled and ethical legal minds working to defend Missouri’s pro-life laws to protect women and save babies.

“As this court case is argued through several court levels, we once again are reminded of how critical elections are in this fight for the protection of innocent human lives.”
